RESOLUTION NO. 2013-09-011

 

A RESOLUTION AMENDING THE PROVISIONS OF THE INTERNAL RULES OF PROCEDURE OF THE NINTH SANGGUNIANG BAYAN OF DINGRAS, ILOCOS NORTE

WHEREAS, the Department of Budget and Management issued Local Budget Circular No. 103, dated May 15, 2013, amending the rules and regulations on the grant of Representation and Transportation Allowances;

 

WHEREAS, there is a need to incorporate said Local Budget Circular in the Internal Rules of Procedure of the Ninth Sangguniang Bayan of Dingras, Ilocos Norte to govern the granting of Representation and Transportation Allowance;

 

WHEREAS, the following Rule and provisions will be added as follows:

           

RULE XVII

RULES AND REGULATIONS ON THE GRANT OF REPRESENTATION AND TRANSPORTATION ALLOWANCE

 

            Sec. 1. Actual work performance, as defined in the inaugural session, constitute the three (3) functions/activities/responsibilities and obligations of a Sangguniang Bayan member, as follows :

  1. Following the Internal Rules of Procedure, which constitute approximately around 75% of the total work performance of the Sangguniang Bayan.   

      a.1 that a Sangguniang Bayan member must attend at least three(3) regular session out of the four(4) regular session as scheduled per month. In cases where a Sangguniang Bayan member is on Official Business/Travel as part of their official work during scheduled session, duly approved by the presiding officer, is considered on the computation of the 75% computation basis of the Representation and Transportation Allowance (RATA).

           

  1. Attendance on committee hearings, committee public hearings on the assigned committees, special session, and visitation/consultation on the district assignment and other barangays within the municipality shall constitute of the 25% of the actual work performance.

      b.1 that in support of the 25% computation basis of the Representation and Travel Allowance(RATA), a concerned Sangguniang Bayan member shall submit a supporting document, such as certificate of appearance to the barangay, certificate of attendance, and attendance in committee hearing or public hearing.

 

            Section 2. The Secretary of the Sangguniang Bayan shall submit to the Human Resource Management Officer and to the Municipal Accounting Office the attendance of the Sangguniang Bayan members and other supporting documents. In cases of attendance to committee hearing, committee public hearing and barangay visitation/consultation, the Sangguniang Bayan member concerned shall submit certificate of attendance or appearance to the SB Secretary.

 

WHEREAS, Section 3 of Rule XIV of the Internal Rules of Procedure which reads as follows:

 

           "Sec. 3. Collection of fines and its disposition. The Secretary to the Sangguniang shall collect the fines as may be imposed by the Sanggunian and shall collect the same from the Treasurer's Office thru Salary Deduction and take custody as a private trust fund" In the disposition or disbursement of the said fund, the Sanggunian shall convert itself into a committee of the whole and then decide upon a majority vote of all its members how and for what purpose the said fund would be spent" is hereby deleted.

 

WHEREAS, there is also a need to include these provisions on the following section of the Internal Rules of Procedure which state as follows:

 

RULE XIV

            Section 1.       

5.a Bringing of firearms and other deadly weapon inside the session hall and in the Office of the Vice Mayor/Sangguniang Bayan is strictly prohibited.

 

6.a All cellular phones brought inside the session hall should be on its silent mode;

 

WHEREFORE, on motion of Hon. Joey S. Apostol duly seconded by Hon. Lester S. Ballesteros, it was,

 

RESOLVED, as it is hereby resolved to amend the Internal Rules of Procedure of the Ninth Sangguniang Bayan in the Municipality of Dingras, Ilocos Norte;

 

RESOLVED FINALLY, to authorize the SB Secretary to transcribe this resolution and furnish copies to all authorities concerned for their information.
